A police officer from the Metropolitan Police was fired after being filmed appearing to enjoy using force during a BBC Panorama program. Pc Jason Sinclair-Birt, based at Charing Cross police station, bragged about using force on a detainee, though he later claimed he was exaggerating for humor. The officer was dismissed for gross misconduct by Chairman Commander Jason Prins.
Three other officers from the same station, Pc Philip Neilson, Pc Martin Borg, and Sergeant Joe McIlvenny, were also dismissed for similar misconduct revealed on the BBC Panorama show. Pc Sinclair-Birt denied the allegations of reveling in excessive force during the incident. However, evidence presented during the hearing contradicted his claims.
The officer was seen in the program describing a physical encounter with a detainee, where he admitted using force on the detainee’s legs. Pc Sinclair-Birt stated that the detainee did not complain, implying satisfaction with his actions. Despite his defense of using humor and exaggeration, the officer’s behavior was deemed unacceptable by the disciplinary panel.
The footage of the incident showed the suspect assaulting Pc Sinclair-Birt by headbutting him, leading to a conviction for assaulting an emergency worker. Pc Sinclair-Birt insisted that his actions were lawful and that he did not resort to excessive force. However, the panel concluded that his remarks and demeanor demonstrated a troubling attitude towards the use of force.
In his defense, Pc Sinclair-Birt claimed that his comments were meant to be taken lightly and were not reflective of his actual behavior during the incident. He stated that he did not intend for his words to be taken seriously and attributed them to a coping mechanism of dark humor. Despite his explanations, the disciplinary panel found his conduct incompatible with the standards expected of a police officer.
