Cartel Bushnell and Leo Knight, who were previously convicted for the manslaughter of 16-year-old Mikey Roynon during a birthday gathering, have now had their convictions overturned, it can be revealed.
Bushnell, aged 17, and Knight, aged 18, saw their convictions quashed at the Court of Appeal after being sentenced for manslaughter. Shane Cunningham fatally stabbed Mikey Roynon with a zombie knife, resulting in his death from a single stab wound at a residence in Bath, Somerset, in June 2023, despite the efforts of emergency responders.
During the trial, it was suggested that Mikey might have been carrying a knife. However, investigations revealed that Mikey did not possess a knife at the time of his death, and no evidence was found to support this claim.
While Cunningham, who remains incarcerated, was convicted of Mikey’s murder in a trial at Bristol Crown Court, Bushnell and Knight were found guilty of manslaughter under joint enterprise, a legal principle applied when it is believed that one individual has assisted another in committing a crime.
Having served more than two years in prison, both Bushnell and Knight successfully appealed their convictions. A retrial had been scheduled for the following month, but during a session at Bristol Crown Court, Christopher Quinlan KC stated that there was no longer a viable chance for the manslaughter convictions.
A Crown Prosecution spokesperson mentioned in a statement that, following a thorough review and changes in available evidence, it was determined that there was no longer a realistic chance of securing a conviction. Three judges today confirmed that the prosecution had withdrawn their evidence in both cases, allowing for the removal of reporting restrictions.
In their ruling, Baroness Carr highlighted a crucial error in the jury instructions that led to the convictions being deemed unsafe. During the trial, Cunningham, from Devizes, Wiltshire, claimed self-defense, stating that he stabbed Mikey after perceiving a threat from a knife wielded by the victim towards his friends.
At the sentencing hearing, Mr. Justice Saini granted permission for the identification of Cunningham, Bushnell, and Knight despite their ages, following a request by the PA news agency.
The judge emphasized the promising future Mikey had and the unimaginable loss suffered by his family. He also noted the prevalent issue of knife crime in Bristol and its neighboring areas.
