“Canada’s Swift Justice System Inspires Reforms at Home”

Last week, while in Canada, I witnessed a swift, fair, and efficient justice system that left me hopeful for crime victims back home. In Toronto’s Ontario Court of Justice, trials were conducted by expert judges without juries, resulting in expedited proceedings. Sentences of up to two years for minor offenses and longer for serious crimes were handed down promptly, without the delays typically associated with jury selection.

Comparing Canada’s legal system to ours, which is also based on common-law principles and a democratic Parliament, highlighted the need for modernization in our courts. The backlog in England and Wales’ Crown Courts has reached alarming levels, with over 80,000 cases awaiting trial, a number that could potentially escalate to 116,000 by 2029. This backlog not only strains the system but also impacts victims’ lives, leaving them in limbo for years while offenders remain at large.

Acknowledging the importance of jury trials for severe crimes like rape, murder, and grievous bodily harm, our justice system is evolving to introduce a ‘Swift Court’ within the Crown Court for cases with expected sentences of three years or less. This reform initiative aims to streamline proceedings, reduce delays, and restore efficiency to the justice system.

While some argue that increased funding is the solution, the bottleneck in the system lies not in infrastructure but in the availability of judges, prosecutors, defense lawyers, and court staff. The evolving landscape, driven by technological advancements and the influx of evidence, has led to longer trial durations, emphasizing the need for systemic reforms to address inefficiencies that have accumulated over time.

The government’s commitment to investing in court modernization and enhancing efficiency is crucial, but systemic reforms are imperative to prevent the justice system from further deterioration. The choice is clear: either continue with the status quo and witness victims suffer as the system falters, or embrace reforms, modernization, and justice restoration.

Canada serves as a model for a more effective approach, showcasing a system that delivers justice swiftly and effectively. The government is resolute in its determination to embark on this path of reform and ensure a more efficient and responsive justice system for all.
