The appeal by a man challenging his sentence for sexual assault has been rejected by the Yukon Court of Appeal. Rudra Amin, now residing in Calgary, was convicted in 2023 of assaulting three women in Whitehorse during 2017 and 2018. The victims reported the incidents in 2020, leading to Amin being found guilty of four counts of sexual assault following a jury trial.
After his sentencing, Amin promptly filed an appeal and was subsequently released on bail. In his appeal, Amin sought a reduction of two months from his just over two-year sentence to become eligible for a conditional sentence order, citing potential immigration consequences. However, Justice Susan Griffin, in her ruling on Aug. 6, dismissed the appeal. She disagreed with Amin’s argument that the original judge had committed errors during sentencing and deemed Amin’s request for a conditional sentence unsuitable.
Griffin stated that Amin’s plea to shorten his sentence by two months was unwarranted unless he could demonstrate a fundamental sentencing error. “This is merely minor adjustment and not within the jurisdiction of this court,” Griffin’s decision stated. Consequently, Amin will serve the entirety of his just over two-year sentence.
